This End User Licence Agreement ("EULA") is a binding legal agreement between you ("User" or "you") and Wallspace ("we", "us", or "our") governing your use of the Wallspace macOS application and any associated content, updates, or services ("the App").
By downloading, installing, activating, or using the App, you confirm that you have read, understood, and agree to be bound by this EULA in full. If you do not agree, do not install or use the App. This EULA should be read alongside our Terms & Conditions and Privacy Policy, which are incorporated by reference.
Subject to your compliance with this EULA and payment of any applicable fees, Wallspace grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to:
This licence does not constitute a sale of the App or any content within it. All rights not expressly granted here are reserved by Wallspace.
Your licence is tied to your purchase or download and is activated through a randomly generated anonymous identifier stored securely in your system Keychain. This identifier is used solely to validate and manage your licence across sessions and devices.
Your licence is subject to a device activation limit as specified at the time of purchase. Attempts to circumvent activation limits — including but not limited to manipulating the Keychain identifier, spoofing device signals, or key sharing — constitute a material breach of this EULA and will result in immediate licence termination.
You may not, and you may not permit or facilitate any third party to:
All content available within the Wallspace library is the property of their respective creators and rights holders. Wallspace provides access to this content under licence and does not claim ownership of any third-party content. Your right to use content accessed through the App is limited to personal, non-commercial use on your own devices.
The Wallspace name, logo, user interface, application code, and all associated intellectual property are owned exclusively by Wallspace and are protected by applicable intellectual property laws. You may not copy, reproduce, or use any of these without our prior written permission.
If you submit content through the App for community sharing, you represent and warrant that:
By submitting content, you grant Wallspace a non-exclusive, royalty-free, worldwide licence to host, display, and distribute the submitted content to other users of the App for personal, non-commercial use. You retain ownership of your content. Wallspace does not claim any intellectual property rights over user-submitted content and may remove any submission at its sole discretion.
Wallspace may from time to time release updates, patches, or new versions of the App. Where such updates are made available, this EULA will apply to the updated version unless a new agreement is presented. We reserve the right to modify, discontinue, or deprecate features of the App at any time without liability to you.
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, Wallspace expressly disclaims all warranties, including but not limited to:
You use the App entirely at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.
To the maximum extent permitted by applicable law, Wallspace, its developers, affiliates, and licensors shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:
In no event shall our total liability to you exceed the amount paid by you for the licence in the twelve months preceding the claim.
Wallspace may terminate your licence immediately and without notice if you breach any provision of this EULA. Upon termination:
You may also terminate this EULA at any time by uninstalling the App. Termination does not entitle you to a refund unless otherwise provided under our Refund Policy.
The App may incorporate third-party libraries, frameworks, or services. These components are subject to their own licence terms, and your use of the App constitutes acceptance of those terms where applicable. Wallspace makes no representations or warranties regarding any third-party components.
This EULA is governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of India.
This EULA, together with our Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and Wallspace regarding the App and supersedes all prior understandings or agreements. No amendment to this EULA will be binding unless made in writing and published on this page with an updated revision date.
